In this video Sam Shamoun reacts to a clip of Jake the Muslim, also known as the Muslim Metaphysician, who says that the majority of Sunni scholars consider a marriage contract valid even if the man marries a woman privately intending to divorce her after a set time. Jake explains that the intention can’t be written into the contract and the woman isn’t told, which is why the scholars treat the contract as valid, and he adds that they don’t call it a good thing. Sam argues this is the Sunni version of mutah and asks how a marriage can be valid if the woman is being deceived. He reads scholarly positions that the schools mostly hold the marriage valid, with the Maliki school disliking it and Awza’i treating it like mutah. Jake also says only men can do this, and he describes the contract as permissible and halal.
