25-Year Attorney REACTS! Context: Bodycam footage from Atlanta, Georgia, captures the aftermath of a catastrophic Pedal Pub rollover that injured all 15 passengers and quickly turned into a DUI investigation. The party bike was traveling through Midtown Atlanta near West Peachtree Street and 14th Street when it overturned during a turn. Passengers blamed the speed of the turn, while the driver claimed riders stood up and shifted their weight. Police soon noticed signs that raised concerns about alcohol impairment, conducted field sobriety testing, and later obtained an Intoxilyzer reading of .171—more than twice Georgia’s .08 limit. This criminal law breakdown examines the case from the prosecutor, defense attorney, and law-professor perspectives. We analyze whether Georgia DUI law applies to a pedal-powered or electric-assisted party bike, the unusual statutory exception that removes certain DUI penalties for true “bicycles,” and why the vehicle’s number of wheels could become legally important. We also examine whether passengers were legally allowed to drink on the Pedal Pub, Atlanta’s open-container and sightseeing-vehicle rules, the company’s alleged permit problems, and whether liability waivers protect the business after a serious crash.
